1. Agreement to Terms

Welcome to WonderEdit! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and S Wave Digital LLC ("we," "us," "our," or "Company") governing your use of the WonderEdit mobile application (the "App" or "Service").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Eligibility

2.1 Age Requirements

You must be at least 13 years of age to create an account and use WonderEdit. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

Recommendation: Due to the nature of AI-generated content, we strongly recommend that users be 18 years or older, especially when generating or editing images of people.

2.2 Account Registration

To access certain features, you must create an account by providing:

A valid email address
A secure password
Optional: Sign in with Apple

You agree to:

Provide accurate, current, and complete information
Maintain the security of your password
Promptly update your account information if it changes
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

2.3 Prohibited Users

You may not use the App if:

You are under 13 years of age
You have been previously banned from the Service
You are prohibited by law from using the Service
You are using the Service from a sanctioned country

3. Description of Service

WonderEdit is an AI-powered image generation and editing application that allows users to:

Generate images from text descriptions (prompts)
Edit existing photos using natural language instructions
Apply AI-powered presets and effects
Manage generated images in a personal gallery (on device)

Technology: The Service uses Google's Gemini 2.5 Flash Image API (Nano Banana) for AI image processing. Image quality, generation speed, and content filtering are subject to Google's AI model capabilities and policies.

Availability: We strive to provide uninterrupted access, but the Service may be unavailable due to:

Scheduled maintenance
Technical issues or outages
Third-party API limitations (Google Gemini)
Force majeure events

No Warranty of Availability: We do not guarantee that the Service will be available 24/7 or error-free.

4. User Content and Conduct

4.1 Your Content

"User Content" means any images, text prompts, or other materials you upload, submit, or generate through the Service.

Your Responsibilities: You represent and warrant that:

You own or have the necessary rights to all User Content
Your User Content does not violate any third-party rights (copyright, trademark, privacy, publicity)
Your User Content complies with these Terms and applicable laws
For images of people, you have obtained proper consent from all identifiable individuals

Important: If you upload or edit images containing identifiable people, you are solely responsible for obtaining their consent. Generating or manipulating images of people without their permission may violate privacy laws, publicity rights, or other legal protections.

4.2 Prohibited Content

You may NOT use the Service to create, upload, or generate:

Illegal Content:

Child sexual abuse material (CSAM) or content sexualizing minors
Content that violates intellectual property rights
Content that violates export control or sanctions laws
Content promoting or facilitating illegal activities

Harmful Content:

Graphic violence, gore, or cruelty
Content promoting terrorism or violent extremism
Content inciting hatred, harassment, or discrimination based on protected characteristics
Non-consensual intimate images or deepfakes

Regulated Content:

Medical or health advice that could cause harm
Financial advice or investment schemes
Misleading political content or disinformation

Trademark/Copyright Violations:

Images of branded products, logos, or copyrighted characters without authorization
Celebrity likenesses used for commercial purposes without consent
Content that infringes on third-party intellectual property

5. Intellectual Property Rights

5.1 Ownership of Generated Images

You Own Your Creations: Subject to Section 5.2, you retain all rights, title, and interest in and to the images you generate using WonderEdit ("Generated Images").

Important: We do NOT claim ownership of your Generated Images, and we do NOT use your images for marketing or AI model training without your explicit consent.

6. Credits and Subscriptions

6.1 Credit System

WonderEdit uses a credit-based system. Each image generation or editing operation typically costs 1 credit.

6.5 Refund Policy

General Policy: All purchases are final and non-refundable except as described below or as required by law.

Since purchases are processed through Apple, you may also request refunds directly from Apple at reportaproblem.apple.com.

7. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (a) $100 USD, OR (b) The amount you paid to us in the 12 months preceding the claim.

9. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising out of these Terms shall be resolved by binding arbitration on an individual basis. You waive the right to participate in class action lawsuits.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@s-wavedigital.com with subject "Arbitration Opt-Out".
